The full terms below are the binding version. The summary is here to make them easy to hold.
Core Elements (the "Platform") is operated by Alicia Hinger, Registered Psychologist, of Core Elements Counselling and Holistic Health (the "Practice"). The Platform is built, administered, and hosted on the Practice's behalf by Oldman AI Solutions Inc. as its service provider. "We", "us", and "our" refer to the Practice and, where the context concerns hosting and administration, its service provider.
By accessing or using the Platform you agree to these terms and to the Privacy Policy. If you do not agree, do not use the Platform. Access is offered only to people invited by the Practice; these terms form part of that invitation.
The Platform provides supportive, educational tools between sessions: an AI companion, a self-paced course, a daily check-in, guided practices, and, when enabled, a reflection assessment. It is an adjunct to, and never a replacement for, the clinical services you receive directly from your practitioner. Behind the scenes, the Practice also uses AI-assisted tools to administer the Platform and prepare its own materials; these work with engagement information and the Practice's own content, never with the private things you write, as described in the Privacy Policy.
The Platform is not psychological treatment, psychotherapy, counselling, diagnosis, medical care, or professional advice, and no practitioner-client service is delivered through it. Nothing the companion says is a clinical opinion. The Platform is not a crisis service and cannot respond to an emergency.
This section matters most, so we are saying it as plainly as we can:
You acknowledge that the Practice has no obligation to monitor Platform activity or to respond to anything entered into the Platform, and that the availability of the Platform does not extend the Practice's professional duties beyond the clinical services delivered directly to you.
The companion is powered by an artificial-intelligence language model. You are always talking to software, never to a person, and you will never be led to believe otherwise. AI output can be incomplete, out of date, or wrong, and can sound confident while being wrong. It is offered for reflection and psychoeducation only. Verify anything important, and bring anything that matters to your practitioner or another qualified professional.
Access is personal to you, by private link or invitation from the Practice. Keep your link private; anyone who has it can open your space. You are responsible for the security of your own device. The Practice may rotate your link for security at any time, and may end Platform access, ordinarily with reasonable notice and in coordination with your clinical care (for example, at the end of your work together). Immediate suspension is reserved for security or misuse. Sections 4, 5, and 10 through 14 survive the end of your access.
Use the Platform only for its intended personal purpose. Do not probe, disrupt, overload, or attempt to gain unauthorized access to it; do not use it to harm yourself or others; do not use it for any unlawful purpose; and do not scrape, resell, or republish any part of it.
The course, practices, recordings, written materials, and the companion's underlying knowledge base are the intellectual property of the Practice or its licensors. You receive a personal, non-transferable, revocable licence to use them for your own reflection while you have access. What you write remains yours; you give us only the limited licence needed to store and process it to run the Platform, as described in the Privacy Policy.
Self-guided reflection can bring up difficult feelings. You agree that you use the Platform voluntarily, that you remain responsible for your own decisions and actions, and that you will seek appropriate professional or emergency help for anything beyond the Platform's stated purpose of supportive education.
The Platform is provided "as is" and "as available", without warranties or conditions of any kind, express or implied, including fitness for a particular purpose, accuracy, availability, or uninterrupted operation, to the maximum extent permitted by applicable law. We do not warrant that the Platform, or any AI output, will meet your needs or be error-free.
To the maximum extent permitted by applicable law: (a) neither the Practice, nor Alicia Hinger personally, nor Oldman AI Solutions Inc., nor their respective contractors will be liable for any indirect, incidental, special, consequential, or exemplary damages, or for loss of data, arising out of or relating to the Platform; (b) their total combined liability for all claims relating to the Platform is limited to $100 CAD or the amount you paid for Platform access in the twelve months before the claim, whichever is greater; and (c) no claim relating to the Platform may be brought more than one year after the events giving rise to it, where such a limit is permitted.
Nothing in these terms limits or excludes liability that cannot be limited or excluded under the law of Alberta, and nothing in these terms limits the professional obligations that apply to the clinical services your practitioner delivers to you directly, outside the Platform.
You agree to indemnify the Practice and its service provider against third-party claims arising from your misuse of the Platform or your breach of these terms, to the extent permitted by law.
These terms are governed by the laws of Alberta and the federal laws of Canada applicable in Alberta, and disputes will be resolved in the courts of Alberta. If any part of these terms is found unenforceable, the rest remains in effect. A failure to enforce a term is not a waiver of it. These terms and the Privacy Policy are the entire agreement about the Platform itself; they do not alter any agreement governing your clinical care.
We may update, pause, or change Platform features, and may update these terms. The current version always lives at this page, with its effective date above. Continued use after a change means you accept the updated terms; for significant changes we will make the update visible in the Platform.
